Returns and Refunds Policy

Article 1 – Purpose

The purpose of these general terms and conditions of sale is, firstly, to inform any prospective consumer of the terms and conditions under which the seller (LES ATELIERS CREPUS) sells and delivers the products ordered and, secondly, to define the rights and obligations of the parties in connection with the sale of products by LES ATELIERS CREPUS to the consumer (the Buyer). They apply, without restriction or reservation, to all sales of the products offered by LES ATELIERS CREPUS on its website www.lesatelierscrepus.com.

Consequently, any person ordering a product offered for sale on the LES ATELIERS CREPUS Website fully and unreservedly accepts these general terms and conditions of sale, which the Buyer acknowledges having read before placing the order.

The products are offered for sale and delivery in the following territories: mainland France (including Monaco and Corsica), all member states of the European Union, Switzerland, the United States and Canada, as well as Martinique, Réunion, Guadeloupe and French Guiana.

For the purposes of these General Terms and Conditions of Sale, the Buyer and LES ATELIERS CREPUS are referred to individually or collectively as the Party or the Parties.

Before placing an order, the Buyer declares that:

• The purchase of products on the LES ATELIERS CREPUS Website is not directly related to any professional activity and is limited to strictly personal use, unless prior consent has been requested from the company’s directors.

• They have full legal capacity to enter into commitments under these general terms and conditions of sale. As a member of a selective distribution network, LES ATELIERS CREPUS sells the products on its Website only at retail and to end consumers.

Any order that clearly does not correspond to a retail sale and, more generally, any order that is fraudulent or presumed to be fraudulent will be considered null and void by LES ATELIERS CREPUS.

LES ATELIERS CREPUS reserves the right to amend these general terms and conditions of sale at any time.

However, the General Terms and Conditions of Sale applicable to an order placed by a Buyer on the LES ATELIERS CREPUS Site are those accepted by the Buyer at the time the order is placed. These General Terms and Conditions of Sale supplement the terms of use of the Site www.lesatelierscrepus.com, available at any time in the General Terms and Conditions of Sale section of the Site and applicable to the Buyer.

Article 3 -Formation of the contract and orders

3.1 Prices

The sale prices of the products online on the LES ATELIERS CREPUS Website, stated in euros, are those in force at the time the Buyer’s order form is recorded.

LES ATELIERS CREPUS may change the sale prices of the products at any time. Any such change will be notified to the Buyer before any order is placed. Prices do not include shipping costs, which are invoiced in addition to the price of the products purchased according to the order amount.

Shipping costs will be shown before the Buyer’s order is recorded.

3.2 Product characteristics

In accordance with Article L. 111-1 of the French Consumer Code, before placing an order the Buyer may consult, on the LES ATELIERS CREPUS Website, the essential characteristics of the product(s) they wish to order.

The Buyer may select one or more products from the various categories offered on the LES ATELIERS CREPUS Website. Offers presented by LES ATELIERS CREPUS are valid while stocks last.

LES ATELIERS CREPUS may change the range of products offered for sale on its Website, in particular in light of constraints relating to its suppliers, without prejudice to orders already placed by the Buyer.

3.3 Orders

Any order implies acceptance of these general terms and conditions of sale, without prejudice to any specific contractual terms agreed between the Parties.

The Buyer is able to check the details of their draft order and to correct any errors.

Once the Buyer confirms their order by clicking on the Confirm icon, they are deemed to have knowingly accepted these general terms and conditions of sale, as well as the prices, volumes and quantities of the products offered for sale and ordered by the Buyer.

The order validated by the Buyer will be confirmed by LES ATELIERS CREPUS.

LES ATELIERS CREPUS recommends that the Buyer keep the information contained in the order confirmation sent by LES ATELIERS CREPUS on paper or in electronic form.

Article 4 – Payment

Payment must be made by the Buyer when placing the order online. Sums paid may be considered as a deposit (arrhes) insofar as they are paid before the consumer’s order is produced.

All orders are payable in euros, inclusive of all mandatory taxes and contributions.

To pay for their order, the Buyer may use the following payment methods: bank card, “PayPal” or bank transfer, under the conditions detailed below.

The bank cards accepted on the LES ATELIERS CREPUS Website are: Carte Bleue, Visa and MasterCard.

Card payments are processed through the secure Stripe system (an online payment tool provided by Stripe, a company certified as a PCI Service Provider Level 1). It uses the SSL (Secure Socket Layer) protocol, so that the information transmitted is encrypted by software and no third party can access it while it travels across the network.

For card payments, the Buyer’s account will be debited on the day of the order.

PayPal and Stripe are secure online payment methods that allow you to shop in complete safety without sharing your bank details.

Online credit notes are issued exclusively by LES ATELIERS CREPUS and may be used by their beneficiary only on the LES ATELIERS CREPUS Website. They are valid for one year from their date of issue.

The Buyer warrants to LES ATELIERS CREPUS that, when recording their order form, they hold the authorisations required to use the payment method chosen for their order.

LES ATELIERS CREPUS reserves the right to suspend or cancel the performance of any order and/or delivery, whatever its nature and stage of performance, in the event of non-payment or partial payment of any sum owed by the Buyer, in the event of a payment incident, or in the event of fraud or attempted fraud relating to the use of the LES ATELIERS CREPUS Website. Penalties shall apply automatically to unpaid amounts after a period of ten days following the payment date or upon notification of the rejection of a bank payment for any other means of payment. Delivery of any new order may be suspended in the event of late or partial payment of a previous order, notwithstanding the provisions hereof.

For amounts over 400 euros, LES ATELIERS CREPUS reserves the right to request a certified copy of the Buyer’s identity card and/or, where applicable, of the bank card (front only) for any payment by bank card or PayPal.

As part of the fight against internet fraud, information relating to your order may be passed on to any third party authorised by law or appointed by LES ATELIERS CREPUS for the sole purpose of verifying the Buyer’s identity, the validity of the order, the payment method used and the intended delivery.

To ensure the security of card payments, the Buyer must provide LES ATELIERS CREPUS with the card verification value (CVV) shown on the back of the bank card used by the Buyer.

Article 5 – Delivery and receipt

5.1 Delivery conditions

5.1.1 General rules

Products that are the subject of a firm order by the Buyer under the conditions described in Article 3.3 above will be delivered to the address given by the Buyer on the order form, only in mainland France (including Monaco and Corsica), all member states of the European Union, Switzerland, the United States and Canada.

By default, purchase invoices are sent by email to the email address provided by the Buyer when registering on the LES ATELIERS CREPUS Site. No claim by the Buyer will be accepted if the contractual conditions described below are not complied with.

5.1.2 Features of La Poste “Colissimo Suivi” delivery

If no one is at home, the Buyer or the recipient of the order receives a delivery notice allowing them to collect the products ordered from the nearest post office indicated on the notice within fifteen days. If the Buyer’s letterbox complies with the standards set by La Poste, the parcel is, in principle, left in it.

The Buyer or the recipient of the products ordered is asked to check the visible condition of the products on delivery. If any visible anomaly (damage, product missing compared with the delivery note, damaged or broken parcel or product, etc.) is noted on delivery in the presence of the La Poste agent, the Buyer or the recipient of the products ordered must follow La Poste’s Colissimo procedure, in particular by reporting the damage or shortfall noted and making any claims and reservations, and must refuse delivery by immediately completing an anomaly report with the La Poste agent (report 170).

The Buyer or the recipient of the products ordered has 3 clear days from receipt of the order to notify the carrier, by recorded delivery letter with acknowledgement of receipt, of any incident relating to the condition or contents of the parcel delivered. They are also asked to report the problem to LES ATELIERS CREPUS by contacting the LES ATELIERS CREPUS customer service: service-client@lesatelierscrepus.com.

Lost parcels

In this case, LES ATELIERS CREPUS is required to comply with the time limits set by La Poste or by the carriers for reporting the loss and reimbursing the shipment. The customer is therefore also bound by these time limits.

Carriers provide the results of their investigations within 1 to 3 weeks.

A refund or the dispatch of a new order will be offered to the customer once the investigation has been concluded. LES ATELIERS CREPUS SAS will do everything possible to satisfy the customer and shorten these time limits.

Receipt of the parcel

Every product delivered must be checked and, in the event of partial or total damage, any reservations must be noted on the carrier’s delivery slip. Without reservations, the product is deemed to have been delivered in good condition and may not be the subject of any subsequent dispute.

Any parcel that is not collected and is returned to LES ATELIERS CREPUS may be re-sent at the recipient’s expense.

Any anomaly concerning the delivery (damage, product missing compared with the delivery note, damaged parcel, broken products, etc.) must be noted on the delivery note in the form of “handwritten reservations”, together with the customer’s signature.

The customer must report the anomalies noted within 3 days. A refund or exchange of the product will be offered to the customer.

Delivery errors

On receipt of the parcel, the customer must notify LES ATELIERS CREPUS by telephone, email or post of any claim that the products do not conform in type, quality or quantity to the information shown on the invoice.

LES ATELIERS CREPUS will bear the return costs for any error attributable to it.

5.2 Delivery times

In accordance with Article L. 216-1 of the French Consumer Code, and unless a more specific time is indicated, the products ordered are delivered no later than thirty (30) days after the contract is concluded, subject to full payment of the price.

For any order confirmed from Monday to Friday (excluding public holidays) before 1 pm on the LES ATELIERS CREPUS Website, the order will be prepared within 15 days, while stocks last. Following validation of your order under the conditions described in Article 3.3 above, delivery times are as follows: – La Poste Colissimo Suivi: 5 working days or less. If these times are exceeded by more than 12 days for reasons other than force majeure, the Buyer may cancel their order by recorded delivery letter with acknowledgement of receipt sent to the contact details given in the “Contact us” section of the LES ATELIERS CREPUS Website.

LES ATELIERS CREPUS will then carry out an investigation with the carrier concerned before refunding the products ordered that were not delivered.

The Buyer may exercise this right to cancel their order for failure to deliver within the contractual time limit within a maximum of sixty working days from the expiry of the maximum delivery time indicated for the products. All sums paid by the Buyer will then be returned to them if the entire order is returned, in the form of a credit note or a refund, at the Buyer’s choice, as soon as possible and no later than thirty days after the date on which the Buyer exercised their right to cancel the order.

Customs

There are no customs duties on products delivered in France or within the European Community. For other countries, customs duties may be payable. It is the customer’s responsibility to contact the customs authorities of their country to make a customs declaration where necessary. LES ATELIERS CREPUS cannot under any circumstances be held liable for any additional cost related to such customs duties.

Please note that the French overseas departments and territories (DOM-TOM) are considered to be outside the European Union and are therefore subject to customs clearance.

Shipping costs

Shipping costs are charged according to the weight of the parcel, the country of delivery and the carrier chosen.

Article 6 – Right of withdrawal

6.1 Time limit

In accordance with Articles L. 221-18 et seq. of the French Consumer Code, the consumer Buyer has fourteen (14) days to exercise their right of withdrawal, without having to give reasons for their decision or bear any costs other than those provided for in Article 6.4.

This period runs from the day on which the Buyer, or a third party designated by them other than the carrier, takes physical possession of the goods. Where several goods ordered are delivered separately, the period runs from receipt of the last item. For services, it runs from the conclusion of the contract.

Where this period expires on a Saturday, Sunday or public holiday or non-working day, it is extended until the next working day.

6.2 How to exercise the right

The Buyer may exercise their right of withdrawal, at their choice:

  • using the online withdrawal function available at https://lesatelierscrepus.com/pages/retractation, in accordance with Article L. 221-21 of the French Consumer Code;
  • using the model withdrawal form annexed to these terms and conditions;
  • by any other unequivocal statement setting out their decision to withdraw, sent by email to contact@lesatelierscrepus.com or by post to LES ATELIERS CREPUS, 27 rue du Chemin Vert, 75011 Paris.

Exercising the right of withdrawal is not subject to any prior agreement from the seller, to any formal requirement as to how it is sent or to the use of any particular packaging. To meet the deadline, it is sufficient for the Buyer to send their statement before the fourteen-day period has expired.

The seller will acknowledge receipt of the withdrawal without delay, on a durable medium.

6.3 Return of the products

The Buyer shall return the products no later than fourteen (14) days after communicating their decision to withdraw, in accordance with Article L. 221-23 of the French Consumer Code. The Buyer is liable only for any diminished value of the goods resulting from handling other than what is necessary to establish their nature, characteristics and functioning.

6.4 Return costs

The direct costs of returning the products are borne by the Buyer, except where the product is non-conforming or damaged or the seller has made an error, in which case they are borne in full by LES ATELIERS CREPUS.

6.5 Refund

LES ATELIERS CREPUS will refund all sums paid, including the initial delivery costs, no later than fourteen (14) days from the date on which the company is informed of the decision to withdraw, in accordance with Article L. 221-24 of the French Consumer Code.

The company may withhold the refund until it has received the products back or until the Buyer has supplied proof of having sent them, whichever is the earlier.

The refund is made using the same means of payment as was used for the order, unless the Buyer expressly agrees to another means. It does not give rise to any costs for the Buyer. If the Buyer chose a delivery method more expensive than the standard delivery offered, delivery costs are refunded on the basis of the standard delivery rate.

6.6 Exceptions

In accordance with Article L. 221-28 of the French Consumer Code, the right of withdrawal may not be exercised for:

  • goods that have been unsealed by the Buyer after delivery and cannot be returned for reasons of hygiene or health protection;
  • goods made to the Buyer’s specifications or clearly personalised;
  • services fully performed before the end of the withdrawal period, where performance began with the Buyer’s express prior consent and express waiver of their right of withdrawal;
  • digital content supplied on an intangible medium, where performance began with the Buyer’s express prior consent and express waiver of their right of withdrawal.

The right of withdrawal does not apply to contracts concluded with professionals acting in the course of their business.

Article 7 – Return of products

The terms of this article apply to commercial returns. They do not apply to the exercise of the right of withdrawal provided for in Article 6, which is not subject to any prior agreement or to any required method of sending.

Any return of products must be formally agreed between the Buyer and LES ATELIERS CREPUS. Products delivered may be returned by the Buyer to LES ATELIERS CREPUS under the conditions and in accordance with the instructions detailed below.

Products must be returned to LES ATELIERS CREPUS in perfect resaleable condition or in their original condition (packaging, accessories, instructions, etc.), duly sealed and accompanied by the Return Form signed by the Buyer.

Returns by parcel or by post

The postage costs for the return parcel remain the responsibility of the Buyer, except where the products delivered do not conform to the order.

Initial delivery costs are not refunded to the Buyer except in the cases referred to in Article 5.2 above on delivery times or in Article 6 above on the exercise of the right of withdrawal, or where the products delivered do not conform to the order.

In the event of an exchange of product(s), the costs of a new delivery of products are borne by the Buyer.

Article 9 – Liability

If one or more provisions of these general terms and conditions of sale are held to be invalid or declared as such pursuant to a law or regulation or following a final decision of a competent court, the remaining provisions shall retain their full force and effect.

Article 11 – No waiver

The fact that one of the parties does not invoke against the other party a breach of any of the obligations set out in these general terms and conditions of sale shall not be interpreted as a waiver of that obligation in the future.

Article 12 – Applicable law and jurisdiction

Sales of products by LES ATELIERS CREPUS are governed by French law. Any dispute relating to the existence, interpretation, performance or termination of the contract concluded between LES ATELIERS CREPUS and the Buyer, even where there are several defendants, shall, failing amicable settlement, fall within the exclusive jurisdiction of the courts of LYON.

Article 13 – “Data protection”

The personal data collected by LES ATELIERS CREPUS when the Buyer places an order are necessary for LES ATELIERS CREPUS and its service providers to manage the order and may be used, subject to the rights exercised by the data subject, to inform them of products or services supplied by LES ATELIERS CREPUS and/or its business partners.
